Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the MedNext Formulary mobile application and website at mednext.uk (collectively, the “Service”), operated by MedNext Ltd (“MedNext”, “we”, “us”).
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
1.1 MedNext Formulary is a digital drug reference tool designed for qualified healthcare professionals. It provides drug monographs, interaction data, dosing calculators, and AI-assisted search.
1.2 The Service is intended as a supplementary clinical reference, NOT as a primary source for prescribing decisions. Users must always exercise independent clinical judgement.
2. Eligibility
2.1 The Service is intended for use by qualified or trainee healthcare professionals aged 18 and over.
2.2 By using the Service, you represent that you are a healthcare professional or student of a healthcare discipline.
2.3 The Service is not intended for use by patients for self-diagnosis or self-medication.
3. Account and Security
3.1 You are responsible for maintaining the confidentiality of your account credentials.
3.2 Each account is for individual use only. Account sharing is prohibited.
3.3 The Service uses device binding for security. Your account may be linked to a maximum of 1 device at a time.
3.4 You must notify us immediately of any unauthorised use of your account.
4. Subscriptions and Payments
4.1 Free Trial: New users receive a 7-day free trial with full access to Ultimate tier features. No credit card is required for the trial.
4.2 Subscription Tiers:
- Free: limited access (drug index only) after trial expiry
- Pro: full drug data, interaction checker, dosing calculators, AI search
- Ultimate: all Pro features plus advanced AI, CME tracking, voice search, risk reports
4.3 Payment is processed through Google Play or Apple App Store. MedNext does not directly handle payment card information.
4.4 Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
4.5 Cancellation: you may cancel at any time through your device's app store settings. You retain access until the end of the paid period.
4.6 Refunds: refund requests are handled by Google Play or Apple App Store per their respective policies.
5. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Redistribute, copy, or republish drug data or content from the Service
- Reverse engineer, decompile, or attempt to extract source code
- Attempt to bypass subscription restrictions or authentication
- Use automated tools to scrape or bulk-download data
- Share your account with others or use the Service on behalf of another person
- Use the Service to provide medical advice to patients without appropriate clinical context
6. Intellectual Property
6.1 All content in the Service (including drug monographs, interaction data, AI-generated content, and the application itself) is the intellectual property of MedNext Ltd or its licensors.
6.2 Drug data is sourced from an open source audited drug database. All data is used under applicable licensing terms.
6.3 You may not reproduce, distribute, or create derivative works from the Service content without written permission from MedNext Ltd.
7. AI-Generated Content
7.1 The Service includes AI-powered features (search, clinical queries, patient advice generation).
7.2 AI-generated content is provided for informational purposes only and must be verified by the user before any clinical application.
7.3 MedNext does not guarantee the accuracy, completeness, or timeliness of AI-generated responses.
7.4 You are solely responsible for any clinical decisions made using AI-generated content.
8. Medical Disclaimer
8.1 THE SERVICE IS A REFERENCE TOOL ONLY. IT IS NOT A SUBSTITUTE FOR:
- Professional medical training and education
- Clinical judgement and patient assessment
- Consultation with colleagues or specialists
- Checking authoritative formularies and guidelines
8.2 Drug information may change. While we strive for accuracy, you should always verify critical information (especially dosing) against current formularies.
8.3 The Service does not account for individual patient factors (allergies, comorbidities, concurrent medications not entered by the user, genetic factors, etc.).
8.4 IN AN EMERGENCY, ALWAYS FOLLOW YOUR INSTITUTION'S PROTOCOLS AND CONTACT APPROPRIATE EMERGENCY SERVICES.
9. Limitation of Liability
9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDNEXT LTD SHALL NOT BE LIABLE FOR:
- Any clinical decisions made based on information from the Service
- Any direct, indirect, incidental, consequential, or special damages
- Loss of data, revenue, or profits
- Service interruptions or downtime
- Errors or omissions in drug data
9.2 Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9.3 Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
10. Service Availability
10.1 We aim for 99.9% uptime but do not guarantee uninterrupted service.
10.2 We may perform maintenance, updates, or modifications to the Service at any time.
10.3 The Service requires an internet connection for full functionality. Offline access is limited to previously cached content.
11. Termination
11.1 You may stop using the Service at any time by uninstalling the app and cancelling your subscription.
11.2 We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Attempt to circumvent security measures
- Use the Service in a way that could harm other users or our infrastructure
11.3 Upon termination, your right to use the Service ceases immediately. Your data will be deleted within 30 days per our Privacy Policy.
12. Changes to Terms
12.1 We may update these Terms periodically. Material changes will be communicated through in-app notification or email.
12.2 Continued use after changes constitutes acceptance. If you disagree, you must stop using the Service.
13. Governing Law
13.1 These Terms are governed by the laws of England and Wales.
13.2 Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
